EcoPoxy's 2024 Contest Terms and Conditions
- Sponsor. The Calendar Contest (“Contest”) is sponsored by EcoPoxy Inc., P.O. Box 220, Morris, Manitoba Canada R0G 1K0 (“EcoPoxy”). This Contest may be posted to various social media platforms including to Instagram and Facebook, however, the sole sponsor of the Contest is EcoPoxy Inc. All entrants in this contest recognize that any social media platform including Instagram or Facebook are in no way a sponsor, endorser of administrator of this Contest and as they are in no way associated with this Contests all entrants release them from any obligation related thereto.
- Eligibility. NO PURCHASE NECESSARY TO PARTICIPATE. This Contest is open to legal residents of Canada and the United States, excluding Quebec, who have reached the age of majority in their province or territory of residence at the time of entry, with the exception of employees of EcoPoxy, its parent, related and affiliated companies, subsidiaries, departments or agencies, franchisees, suppliers, advertising and promotional agencies, contest administrators, and any other parties engaged in the development, production, or distribution of Contest materials, and those living in the same household. By participating in this Contest, entrants acknowledge compliance with, and agree to be bound by, these Contest Rules. Entrants who do not comply with any of the Contest Rules are subject to disqualification by EcoPoxy, in EcoPoxy’s sole discretion.

3. Contest Dates and Times. The Contest begins on September 20, 2023 at 12:00m. CST and ends on October 4, 2023, at 11:59 p.m. CST (Contest End Date), after which time the Contest will be closed and no further entries will be accepted.
4. How to Enter. All Entrants agree and understand that upon submitting their entry to EcoPoxy’s 2024 Calendar Contest, they consent to the terms and conditions found in paragraph 11 herein, regardless of whether they are selected as a prize winner for EcoPoxy’s 2024 Calendar Contest. Entrants must complete the entry form found at ecopoxy.com by providing a photo submission, filling in all required fields on the form and agreeing to the Terms and Conditions of EcoPoxy’s 2024 Calendar Contest to be entered into the contest. For this Contest, receipt of an Internet entry occurs when EcoPoxy's server records the entry information (hereinafter referred to as “Contest Entry”). All Contest Entries are subject to verification by EcoPoxy, in its sole discretion. There is no limit to the number of entries which may be submitted. Any attempt or suspected attempt to use robotic, automatic, programmed or otherwise illicit means to enter the Contest, or any other methods not authorized by these Contest Rules, shall be deemed as tampering and may disqualify you from entering, participating and/or winning a prize. Contest Entries that contain false or incomplete information are void. Contest Entries that are late, lost, stolen, illegible, contain false information, are damaged, misdirected, mutilated, garbled or incomplete, altered or otherwise irregular or that do not conform with or satisfy any or all of the conditions of the Contest Rules are void. Entrants grant EcoPoxy a non-exclusive licence to use all Contest Entries for any purpose immediately upon Entry submission. No correspondence will be entered into except with Selected Entrants. Proof of transmission (for example, screenshots or captures) does not constitute proof of entry or receipt of an entry.
First Place: 30 L FlowCast, 80 mm mixer, canvas apron, 1 pour pail, 1 roll of tape, 8pc – 60 mL colour pigment set, calendar feature, certificate.
Approximate value of this prize $897.00.
Second Place: 20 L UVPoxy kit, spreader, canvas apron, set of 10 – 5 g metallic colour pigments, set of mixing cups (2 of each size), calendar feature, certificate.
Approximate total value of this prize is $600.00.
Third Place: 6 L FlowCast SPR, 45 mm mixer, canvas apron, 1 roll of tape, set of 10 – 5 g metallic colour pigments, calendar feature, certificate.
Approximate total value $285.00.
People’s Choice Prize: 15 L SnowWhite kit, 80 mm mixer, canvas apron, 1 roll of tape, calendar feature, certificate.
Approximate value $545.00.
All entrants assume any and all liability for any injury or damage caused, or claimed to be caused, by entering, participating in this Contest or the use or redemption of a prize. Prizes must be accepted as awarded and have no cash value. Prizes or any portion of a prize cannot be combined with other discounts, promotions, or special offers. EcoPoxy reserves the right to substitute an alternate prize of equal or greater value if an advertised prize unavailable at the time of award.
6. Odds of Winning. For all prizes the odds of winning depend on the number of eligible Contest Entries received before the Contest End Date. The odds of winning the People’s Choice Prize depends on the number of eligible Contest Entries before the Contest End Date and the number of votes received on EcoPoxy’s Instagram page.
7. Skill-testing Question. Selected Entrants will be required, as a condition of winning a prize, to correctly answer, without assistance of any kind, EcoPoxy’s time-limited, mathematical skill-testing question which will be provided to entrants selected as winners of the contest with the Winner Release Forms.
8. Winner Selection and Confirmation. On October 10, 2023 at beginning at 10:30 a.m. CST at EcoPoxy Inc. located in Morris, Manitoba, Canada R0G 1K0, four (4) judges (Eugene Rothwell, Lisa Marmillod, Matt Sauerbrei, and Rayanne Maendel) will choose five (5) entries each basing their choice on technical and artistic skill, these entries will be approved by a final judge (Jack Maendel). Those selected will represent the top twenty (20) entries in the contest and will be featured in EcoPoxy’s calendar for the year 2024. These twenty (20) entries will continue to the next stage of selection where the judges will award first, second, and third place prizes based on the entrants artistic and technical skill.
The remaining seventeen (17) entries will be posted on EcoPoxy’s Instagram page for a 24-hour period beginning October 17, 2023 at 12:00 p.m. CST and ending October 18, 2023 at 12:00 p.m. CST where their peers will vote to choose the winner of the prize for People’s Choice. Once the People’s Choice Award has been selected, the remaining sixteen (16) entries will receive the additional features in the 2024 calendar.
Between October 12, 2023, at 12:00 p.m. CST and October 13, 2023 at 12:00 p.m. CST the top twenty (20) selected entrants will be notified that they will be featured in EcoPoxy’s 2023 calendar and will receive EcoPoxy’s Winner Release Form a signed copy of which must be returned no later than October 20, 2023. The top three (3) entries will be notified of the prize they have won and the remaining seventeen (17) will be notified that their entry will be posted on EcoPoxy’s Instagram page to be judged by their peers for the People’s Choice prize. Up to three attempts to contact the top twenty (20) selected entrants will take place.
The People’s Choice prize will be selected awarded to the entry that receives the most votes on Instagram in a 24-hour period beginning on October 17, 2023 at 12:00 p.m. CST and ending on October 18, 2023, at 12:00 p.m. CST.
Winners will receive a prize, if they meet all of the eligibility criteria set out in these Terms and Conditions. If a Selected Entrant does not meet the eligibility criteria, he/she will be disqualified from winning the contest and will not receive a prize and another entrant will be selected from the remaining eligible Contest Entries by the same judging panel on the same basis of technical or creative skill. Entrants agree and understand that upon submitting their entry to EcoPoxy they consent to the terms and conditions found in paragraph 11 herein, regardless of whether they are selected as a prize winner for EcoPoxy’s 2024 Calendar Contest.
A selected entrant that does not or cannot accept a prize may be forfeited and a new entrant will be selected by the panel of judges based on technical and artistic skill , in EcoPoxy’s sole discretion. EcoPoxy is not responsible for the failure for any reason whatsoever of a selected entrant to receive notification or for EcoPoxy to receive a selected entrant’s response. A list of winners will be posted on our website, and available by request via marketing@ecopoxy.com or 1-855-326-7699.
Disputes regarding identity of entrant: If the identity of a selected entrant is disputed, the entry will be deemed to have been submitted by the individual assigned to the email address submitted at the time of entry. Each selected entrant may be required to provide proof that he/she was of legal age in his/her province at the time of Entry.
9. EcoPoxy is not responsible for:
a.incorrect or inaccurate entry information that may affect a person’s ability to participate in the Contest or be awarded a prize, including but not limited to human error, technical malfunctions, lost or delayed Contest Entries for any reason, omission, or any combination thereof, and Contest Entries that fail to fully comply with these Contest Rules;
b. technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software;
c.lost, incomplete, delayed, mutilated, or misdirected Contest Entries or Winner Releases;
d.injury or damage to entrants’ computers or to any other individual’s computer related to or resulting from participating in or downloading any material regarding the Contest or accepting a prize;
e. any injury or damage to persons or property which maybe caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use or misuse of any prize, and the use of Contest Entries;
f. the security or privacy of information transmitted via computer networks or for breaches of privacy due to interference by third-party computer hackers or otherwise; or
g. late, lost, misdirected or unsuccessful efforts to notify a potential winner.
10. Winner Release Forms. All winners must sign EcoPoxy’s Winner Release to:
a. Confirm compliance with all Contest Rules;
b. Agree to accept prizes as awarded;
c. Confirm they understand and agree to comply with paragraph 11 - Content Consent and Release herein.
11. Content Consent and Release. The term “Content” refers to all information provided by the entrant for the contest including but not limited to any images, photographs, and pictures, together with any modifications, reproductions, and depictions of same, and together with any and all intellectual property rights relating thereto.
a. Entrant consents and grants to EcoPoxy the irrevocable right and unrestricted permission, in perpetuity, worldwide to:
i.edit, combine and modify the Content at its discretion; and
ii. publish, make, distribute, show, record, reproduce, use, broadcast, translate into other languages, formats and/or mediums and exploit the Content in any manner, form, format, or media whatsoever now or hereafter or later known, for the purpose of trade, advertising, describing, publicizing, or promoting EcoPoxy and its activities, products and services (the “Purpose”).
b. Entrant represents and warrants that:
i. the Entrant owns or otherwise controls all the rights, including moral rights and intellectual property rights, to the Content;
ii. the Entrant can grant or has obtained all rights and consents that are necessary for them to grant any rights and licences described herein and relating to the Content to EcoPoxy;
iii. the Content is accurate and is original to the Entrant and that no other party has any rights thereto;
iv. the Content will not infringe the rights of any third party and will not otherwise cause injury to any person or entity;
v. the Entrant will immediately notify EcoPoxy of any Content that does not comply with the contents herein or may infringe the rights of a third party or third parties; and
vi. the Entrant has consent of third parties to use their likeness if applicable to the Content.
c. Entrant understands that:
i. the Content may appear on EcoPoxy’s website and social media accounts and that the Internet is not a secure medium;
ii. any material posted on the Internet is accessible to and may be copied or altered by anyone with a computer;
iii. EcoPoxy cannot absolutely guarantee privacy or control the access to its website and social media accounts; and
iv. an inherent risk may include but is not limited to identity theft or danger to the Entrant.
d. Entrant waives:
i. any right to inspect or approve the Content or the uses of the Content, and any advertising copy or printed matter that may be used,
ii. all moral rights in the Content, and
iii. any right to royalties or other compensation arising from or related to the Content or the use of the Content by EcoPoxy.
e. Entrant agrees and acknowledges that all right, title, and interest in the Content shall be the sole exclusive property of EcoPoxy free and clear of all claims of any kind whatsoever by the Entrant. The Entrant assigns and transfers to EcoPoxy his/her entire right, title, and interest, if any, worldwide, in and to the Content, without any remuneration.
f. Entrant releases and forever discharges EcoPoxy from and against any and all demands, causes of action, liability and claims, at law or in equity, of any nature or kind, including, without limitation, any action for copyright infringement, rights of publicity, misappropriation of personality, breach of privacy, invasion of privacy, defamation, libel or slander, that the Entrant or his/her heirs, executors, administrators, personal representatives, successors or assigns can, has ever had, now or may hereafter have arising out of or connected in any way with the Content.
g. Entrant acknowledges that EcoPoxy will rely on this Content Consent & Release potentially at substantial cost to EcoPoxy, and the Entrant agrees not to assert any claim of any nature whatsoever against anyone relating to the exercise of the provisions of this Content Consent & Release.
h. Entrant indemnifies EcoPoxy against any loss, damage, or expense, including legal fees, that any of the Released Parties may suffer or incur as a result of any non-compliance by entrants with any of the Contest Rules or participation in the Contest and/or in connection with the acceptance and/or exercise by an entrant of a prize, and the use of Contest Entries by EcoPoxy.
12. Intellectual Property. All intellectual property, including but not limited to trademarks, logos, designs, promotional materials, web pages, source codes, images, drawings, illustrations, slogans, and representations are owned by EcoPoxy. All rights reserved. Unauthorized copying or use of any of the EcoPoxy’s intellectual property without EcoPoxy’s express written consent is strictly prohibited.
13. Rule Amendments. EcoPoxy reserves the right, in its sole discretion, to amend or modify these Contest Rules, or modify, cancel, or suspend this Contest, without prior notice for any reason whatsoever, including without limitation in the event that any cause beyond the reasonable control of EcoPoxy corrupts, or threatens to corrupt, the security or proper administration of the Contest.
14. Other Conditions. EcoPoxy reserves the right to terminate or amend this Contest at any time and in anyway, without prior notice to entrants. Without limiting the foregoing, if, for any reason, the Contest is not capable of running as originally planned for any reason, EcoPoxy reserves the right to cancel the Contest and conduct a random draw from all previously received eligible Contest Entries received by the Contest End Date.
15. Law. The contest is void where prohibited by law and shall be governed exclusively by the laws of the province of Manitoba, and the laws of Canada including all issues and questions concerning the construction, validity, interpretation, and enforceability of these Contest rules, rights, and obligations between entrants and EcoPoxy, and procedural provisions, without giving effect to any choice of law or conflict of law rules. Any dispute shall be adjudicated by the courts sitting in Winnipeg, Manitoba.
16. Privacy and Personal Information. By participating in the Contest, Entrants are providing their consent to the use of their name, address, email address, postal code, telephone number, social media handle(s), comments, and image, whether a photograph, or any other means, for the administration of the Contest or any publicity carried out by EcoPoxy, without further notice or compensation.Collection, Use, Storage, and Destruction: EcoPoxy will collect the name, phone number, email address, home address, Instagram handle and Facebook Page of Entrants for the purpose of contacting contest winners, recognizing their work on EcoPoxy’s website and social media accounts, and for distributing prizes to the winners. EcoPoxy has put appropriate administrative, technical, and physical measures to protect the Personal Information you provide to us, your personal information will only be used to execute this contest after which it will be permanently deleted unless you provide your consent otherwise.
Your Rights: Entrants may withdraw their consent to the use of their Personal Information at any time by contacting EcoPoxy’s legal department, however, if an entrant withdraws consent EcoPoxy will have no way to contact that entrant or distribute prizes to that entrant.
